Welcome to Rucksack Resale (“we,” “us,” “our”). By accessing, browsing, bidding, or purchasing through our website, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use this site.

1. Nature of the Business

Rucksack Resale operates as an online auction and liquidation marketplace. Items sold may include new, open-box, used, refurbished, returned, or liquidation merchandise.

All items are sold AS-IS, WHERE-IS, with no warranties, express or implied.

2. Eligibility & User Responsibility

By using this site, you represent that you:

  • Are at least 18 years of age

  • Have legal capacity to enter binding agreements

  • Will provide accurate and complete information

  • Are responsible for maintaining account security

You are responsible for all activity conducted under your account.

3. Auctions & Bidding

  • All bids are binding offers to purchase.

  • Winning an auction constitutes a legal obligation to pay.

  • Bids may not be retracted except where required by law.

  • Failure to complete payment may result in account suspension or cancellation.

Rucksack Resale reserves the right to:

  • Cancel or void auctions due to error, fraud, or technical issues

  • Remove users suspected of abuse or manipulation

  • Correct listing errors prior to auction close

4. Pricing & Payment

  • Prices reflect liquidation and auction values.

  • Payment must be completed promptly after auction close or purchase.

  • We reserve the right to refuse or cancel orders for suspected fraud or non-payment.

All payments are processed through Shopify-approved payment providers.

5. Final Sale – No Returns or Refunds

ALL SALES ARE FINAL.

  • No returns

  • No refunds

  • No exchanges

This applies to all items, including auction wins, electronics, appliances, and liquidation merchandise.

6. Item Condition & Descriptions

  • Items are inspected prior to listing.

  • Listings include actual photographs of the item being sold.

  • Known defects or missing components are disclosed when identified.

Normal wear, cosmetic blemishes, missing packaging, or signs of prior use are expected in liquidation items and do not constitute misrepresentation.

7. Shipping & Risk of Loss

  • Buyer is responsible for all shipping costs.

  • Shipping charges are non-refundable.

  • Risk of loss transfers to the buyer upon confirmed delivery by the carrier.

Rucksack Resale is not responsible for carrier delays, damage, or loss after shipment.

8. Electronics & Appliances

For electronics, appliances, and powered items:

  • Manufacturer warranties may not apply

  • No guarantees are made regarding lifespan or future performance

  • Buyer assumes all risk after delivery

9. Prohibited Conduct

You agree not to:

  • Engage in fraudulent bidding or chargebacks

  • Manipulate auctions or pricing

  • Abuse customer support

  • Use the site for unlawful purposes

  • Attempt to reverse-engineer or interfere with site functionality

Violations may result in account termination.

10. Chargebacks & Disputes

Initiating a chargeback or payment dispute does not override these Terms.

By purchasing, you acknowledge:

  • Clear notice of final-sale terms

  • That buyer’s remorse or dissatisfaction is not a valid dispute basis

  • That these Terms may be submitted to payment processors as evidence

11. Limitation of Liability

To the fullest extent permitted by law:

  • Rucksack Resale shall not be liable for indirect, incidental, or consequential damages

  • Liability shall not exceed the amount paid for the item giving rise to the claim

12. Indemnification

You agree to indemnify and hold harmless Rucksack Resale from any claims, losses, or damages arising from:

  • Your use of the site

  • Your violation of these Terms

  • Your breach of applicable law

13. Intellectual Property

All site content, including text, images, branding, and layouts, is owned by Rucksack Resale and may not be used without permission.

14. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict-of-law principles.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the site constitutes acceptance of updated Terms.
